US Congress passes AI judicial bias audit bill BiasAudit, requiring all AI systems used in criminal justice to undergo annual independent third-party race and gender bias audits, with non-compliant systems forced offline.

On December 2, 2029, the US Senate passed the AI Judicial Bias Audit Bill BiasAudit by a vote of 71 to 29. The bill requires all AI tools used in the criminal justice system — including sentencing recommendations, bail risk assessments, and crime prediction systems — to undergo annual independent third-party bias audits.

BiasAudit's audit standards are set by the National Institute of Standards and Technology (NIST), covering four dimensions: race, gender, age, and income level. Audit reports must be publicly published, and any system found to have significant bias during auditing will be required to complete remediation within 90 days or face forced shutdown.

The key event that drove the bill was a federal lawsuit in August 2029. A defense attorney team for an African American defendant proved that the AI risk assessment system denying their client bail had a 34% higher denial rate for African American defendants than white defendants with equivalent criminal records. The case sparked nationwide discussion and directly gave rise to the BiasAudit bill.

The US Assistant Attorney General for the Criminal Division said BiasAudit is not about banning AI in the judicial field but ensuring AI systems do not replicate and amplify existing social biases.

However, the bill also faces implementation challenges. Over 3,000 counties across the US use different types of judicial AI systems, and unifying audit standards and enforcement is a massive administrative challenge. NIST expects to release final audit technical standards in Q3 2030.
