The European Commission officially released the PriceFair algorithmic pricing antitrust framework on August 24, 2030, the world's first regulatory framework specifically targeting AI dynamic pricing systems. The framework requires all enterprises operating in the EU that use AI dynamic pricing to disclose core pricing algorithm logic to regulators and strictly prohibits discriminatory pricing based on individual consumption history, browsing behavior, or social data.

PriceFair was prompted by the proliferation of AI dynamic pricing. According to statistics, 67% of online retailers in the EU market were already using AI systems for real-time price adjustments in 2030. These systems can adjust product prices at millisecond speed based on factors including supply and demand, competitor prices, inventory levels, and user profiles.

The framework's core requirements cover three areas. First, algorithm transparency — enterprises must submit technical documentation of their pricing algorithms to the EU Directorate-General for Competition, including data sources used, pricing logic, and price adjustment frequency. Second, price fairness auditing — independent third-party auditors conduct annual fairness assessments of enterprises' pricing algorithms to ensure no price discrimination against specific groups. Third, consumer right to information — consumers have the right to request that enterprises provide the calculation basis for their personalized price.

EU Competition Commissioner Margrethe Vestager said: "AI dynamic pricing should not become a tool for enterprises to engage in price discrimination against consumers. PriceFair ensures that technological progress does not harm consumers' right to fair transactions."

The framework's definition of "discriminatory pricing" is very strict. The following data are prohibited from use in personalized pricing: consumer income levels, geographic location (at postcode level), device type (e.g., Apple vs. Android users), browsing history, and personal health data.

During the public consultation before PriceFair's release, tech giants' reactions were polarized. Amazon and Uber opposed the framework, arguing that dynamic pricing reflects market efficiency and that restricting pricing freedom would harm competition. However, consumer advocacy organizations and EU member state governments broadly supported it.

Notably, PriceFair addresses "algorithmic collusion." The framework explicitly prohibits enterprises from using AI systems for implicit price coordination — even without direct communication, if multiple enterprises' AI pricing systems effectively synchronize prices by observing competitors' price changes, this may be deemed anti-competitive behavior.

PriceFair will take effect on June 1, 2031, giving enterprises a 12-month compliance transition period. Violating enterprises will face fines of up to 4% of global revenue.
